Welcome to Telecom11! The terms "we," "us," and "our" refer to Telecom11. Telecom11 manages this store and website, including all related information, content, features, tools, products and services to provide you, the customer, with a customized shopping experience (the "Services"). Telecom11 is powered by Shopify, which enables us to deliver the Services to you.

The following terms and conditions, together with any policies referenced herein (these "Service Terms" or "Terms") describe your rights and responsibilities when using the Services.

To use the Services, including opening or browsing our webshops or purchasing any of the products or services we offer, you may be asked to provide certain information, such as your email address, billing address, shipping address and payment information. You are solely responsible for the confidentiality of your account login credentials and for all your account activities. You may not transfer, sell, assign or license your account to another person.

However, please note that colors or appearance of products may differ from how they appear on your screen, due to the type of device you use to access the store and the settings and configuration of your device.

We do not guarantee that the appearance or quality of products or services you purchase will meet your expectations or be the same as depicted or delivered in our webshops.

All product descriptions may be changed at any time without prior notice at our sole discretion. We reserve the right to discontinue any product at any time and may limit the quantities of products we offer to any person, geographic region or jurisdiction on a case-by-case basis.

SECTION 3 - ORDERS

When you place an order, you are making an offer to purchase. Telecom11 reserves the right to accept or refuse your order for any reason at its sole discretion. Your order is only accepted once Telecom11 has confirmed acceptance. We must receive and process your payment before your order is accepted. Please review your order carefully before submitting it, as Telecom11 may not be able to process cancellation requests after an order has been accepted. If we do not accept, modify or cancel an order, we will attempt to notify you by contacting the email address, billing address and/or phone number you provided when placing the order.

Your purchases may only be returned or exchanged in accordance with our Refund Policy.

You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.

SECTION 4 - PRICING AND BILLING

Prices, discounts and promotions may be changed without prior notice. The price charged for a product or service is the price in effect at the time the order is placed and is stated in your order confirmation email. All stated prices include VAT (btw). Shipping costs are not included in the stated prices and are shown separately at checkout (EUR 4.99; free shipping for orders of EUR 30 or more).

Prices in our webshops may differ from prices in physical stores or in online stores or other stores operated by third parties. We may from time to time offer promotions on the Services that may affect pricing and that are subject to separate terms and conditions apart from these Terms. If there is a conflict between the terms of a promotion and these Terms, the terms of the promotion apply.

You agree to provide current, complete and accurate purchase, payment and account information for all purchases you make in our stores. You agree to promptly update your account and other information, including your email address, credit card numbers and expiration dates, so that we can complete your transactions and contact you if necessary.

You represent and warrant that (i) the credit card information you provide is truthful, accurate and complete, (ii) you are properly authorized to use such credit card for the purchase, (iii) charges made by you will be honored by your credit card company, and (iv) you will pay charges made by you at the stated prices, including shipping and handling fees and all applicable taxes, if applicable.

SECTION 5 - SHIPPING AND DELIVERY

We are not liable for delays in shipping and delivery. All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by carriers, customs clearance or events beyond our control. Once we transfer the products to the carrier, title and risk of loss transfer to you.

SECTION 6 - INTELLECTUAL PROPERTY

Our Services, including but not limited to all trademarks, marks, text, displays, images, graphics, product controls, video and audio, and the design, selection and arrangement thereof, are owned by Telecom11, its affiliates or licensors and are protected by U.S. and foreign patent, copyright and other intellectual property laws.

These Terms permit you to use the Services solely for personal, non-commercial use. You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store or transmit the material on the Services without our prior written permission. Unless expressly stated otherwise herein, nothing in these Terms grants you a license or other rights or shall be construed as granting you a license or other rights under any patent, trademark, copyright or other intellectual property of Telecom11, Shopify or a third party. Unauthorized use of the Services may violate federal and state intellectual property laws. All rights not expressly granted herein are reserved to Telecom11.

The names, logos, product and service names, designs and slogans of Telecom11 are trademarks of Telecom11 or its subsidiaries or licensors. You may not use such trademarks without prior written permission of Telecom11. Shopify's name, logo, product and service names, designs and slogans are trademarks of Shopify. All other names, logos, product and service names, designs and slogans on the Services are trademarks of their respective owners.

SECTION 7 - OPTIONAL TOOLS

You may have access to customer tools provided by third parties as part of the Services, over which we have no control or input.

You acknowledge and agree that we provide access to such tools "as is" and "as available," without warranties, representations or conditions of any kind and without any approval. We have no liability arising from or related to your use of optional tools from third parties.

Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and agree to the terms under which tools are offered by the relevant third-party providers.

SECTION 9 - RELATIONSHIP WITH SHOPIFY

Telecom11 is powered by Shopify, which enables us to provide the Services to you. However, all sales and purchases you make in our Store are made directly with Telecom11. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of a sale between you and Telecom11, including injury, damage or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages and liabilities arising from or related to your purchases and transactions with Telecom11.

SECTION 10 - PRIVACY POLICY

All personal information we collect through the Services is subject to our Privacy Policy, and certain personal information may be subject to Shopify's Privacy Policy, which you can view here. By using the Services, you acknowledge that you have read this privacy policy.

Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve the Services for you. We may terminate this agreement or your access to the Services (or any part thereof) at any time at our sole discretion and without prior notice, and you remain liable for all amounts due through the date of termination.

The following sections survive termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver; Entire Agreement, Assignment, Governing Law, Privacy Policy and other provisions that by their nature must remain in force after termination.

The information presented on or through the Services is provided for general informational purposes only. We do not warrant the accuracy, completeness or usefulness of this information. WE DO NOT WARRANT THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE. TO THE EXTENT PERMITTED BY LAW, IN NO EVENT SHALL TELECOM11, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS OR LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, BUT NOT LIMITED TO, LOSS OF PROFIT, LOSS OF INCOME, LOST SAVINGS, DATA LOSS, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGE, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF THE SERVICES OR PRODUCTS PURCHASED USING THE SERVICES, OR FOR ANY OTHER CLAIM IN ANY WAY RELATED TO YOUR USE OF THE SERVICES OR ANY PRODUCT, INCLUDING BUT NOT LIMITED TO ERRORS OR OMISSIONS IN CONTENT, OR ANY LOSS OR DAMAGE OF ANY KIND ARISING FROM USE OF THE SERVICES OR ANY CONTENT (OR PRODUCT) POSTED, SENT OR OTHERWISE MADE AVAILABLE VIA THE SERVICES, EVEN IF YOU HAVE BEEN ADVISED OF THE POSSIBILITY THEREOF.

SECTION 18 - INDEMNIFICATION

You agree to indemnify, defend and hold harmless Telecom11, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors and service providers from all losses, damages, liabilities or claims, including reasonable attorneys' fees, payable to third parties arising from or resulting from (1) your breach of these Service Terms or the documents referenced herein, (2) your breach of any law or the rights of a third party, or (3) your access to and use of the Services.

We will notify you of any claim eligible for indemnification, provided that failure to notify you promptly will not relieve you of your obligations unless you are materially harmed. We may arrange the defense and settlement of such a claim at your expense, including the choice of counsel, but will not settle any claim requiring non-monetary obligations from you without your consent (which may not be unreasonably withheld). You will cooperate in the defense of claims, including by providing relevant documents.

SECTION 19 - SEVERABILITY

In the event that any provision of these Service Terms is found to be unlawful, void or unenforceable, such provision shall nevertheless be enforceable to the extent permitted by applicable law and the unenforceable portion shall be deemed severed from these Service Terms, and such determination shall not affect the validity and enforceability of the remaining provisions.

Welcome to Telecom11! By using our webshop and purchasing products, you agree to the service terms below. Please read these terms carefully before making a purchase.

1. General

1.1 Telecom11 is a trading name, based in Utrecht (KvK 73999628).

1.2 These general terms apply to all offers, sales and agreements concluded via the Telecom11 webshop.

1.3 By using our website and/or placing an order, you agree to the applicability of these terms. If you do not agree with these terms, we ask you not to use our webshop.

2. Offer and Product Information

2.1 The products presented on Telecom11 are an offer, subject to availability.

2.2 We make every effort to describe and depict products as accurately as possible. However, color or product variations may occur due to various factors such as display settings or product variations.

2.3 We reserve the right to make changes to products or prices on the website without prior notice.

3. Ordering and Payment

3.1 An order is concluded when you place an order and we confirm it via email or other means of communication.

3.2 All prices on Telecom11 are in euros and include VAT (btw). Shipping costs are shown separately at checkout.

3.3 Payments must be made in full at the time of order via the available payment methods, such as iDEAL, Credit Card, PayPal, or other offered payment options.

3.4 If payment is not received within the specified period, we reserve the right to cancel the order.

4. Delivery

4.1 We aim to deliver orders within 2 business days, unless otherwise indicated on the product page.

4.2 Deliveries are carried out via a delivery service of our choice.

4.3 Telecom11 is not liable for delays or damage resulting from unforeseen circumstances, such as delays by the carrier or force majeure.

4.4 Delivery times are indicative. Any delays do not entitle you to compensation or cancellation of the order, unless otherwise agreed.

5. Right of Withdrawal and Returns

5.1 As a consumer, you have the right to cancel the agreement within 14 days of receiving the goods without giving reasons (right of withdrawal).

5.2 You may return the products by notifying us within the period of 14 days after receipt of your decision to cancel the agreement.

5.3 The costs of returning the products are at your own expense, unless otherwise agreed.

5.4 The product must be returned in original condition and packaging, and must not show signs of use.

5.5 Upon successful return, you will receive the purchase amount within 14 days, provided the product is received in good condition.

6. Warranty and Liability

6.1 The products you purchase from Telecom11 are covered by the statutory warranty. This means that a product must meet the reasonable expectations you can have of it.

6.2 If a product is defective or damaged, you are entitled to a repair, replacement product, or refund, depending on the situation and applicable law.

6.3 Telecom11 is not liable for damage resulting from incorrect use of the product or failure to follow the instructions for use. Or failure to have it installed/mounted by a professional.

7. Privacy and Data Processing

7.1 Telecom11 respects your privacy and processes your personal data in accordance with applicable law, such as the General Data Protection Regulation (GDPR).

7.2 Your data will only be used to process your order, provide customer service and provide information you have requested.

10. Applicable Law and Disputes

10.1 These service terms are governed by Dutch law.

10.2 Any disputes shall be submitted to the competent court in the Netherlands, unless a mandatory law provides otherwise.
